All other wood bat models, including but not limited to: Pro Select, Youth Ultra Lite, Fungos, Training bats, and Trophy Bats do not carry a warranty. THE BAT MUST HAVE BEEN PURCHASED FROM AN AUTHORIZED TUCCI DEALER&#xA0;(Warranty does not apply to bats purchased from non-authorized third parties, including but not limited to sellers operating on third-party auction sites unless those sellers are authorized TUCCI dealers. To obtain warranty coverage, please select your retailers carefully and make sure your retailer is an authorized TUCCI dealer. Once received, TUCCI generally reviews warranty claims within two business days; review times may vary.6. You and TUCCI Limited (&#x201C;TUCCI&#x201D;) agree that any dispute, claim, or controversy between you and TUCCI arising out of or relating in any way to a TUCCI product, the advertising, marketing, sale, purchase, use, condition, performance, alleged defect, repair, replacement, or warranty service for a TUCCI product, this Limited Warranty, or the relationship or dealings between you and TUCCI (each, a &#x201C;Dispute&#x201D;) will be resolved exclusively by final and binding individual arbitration and not in court. A Dispute includes claims based on contract, warranty, tort, statute, regulation, fraud, misrepresentation, consumer-protection law, or any other legal or equitable theory, whether arising before or after your purchase, except that this provision does not apply to a Dispute for which applicable law prohibits pre-dispute binding arbitration. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. &#xA7;&#xA7; 1&#x2013;16, and evidences a transaction involving interstate commerce.Notice and Informal Resolution. Before commencing arbitration, the party asserting a Dispute must send the other party an individualized written notice describing the claimant&#x2019;s name and contact information, the product and purchase at issue, the factual and legal basis of the Dispute, and the relief requested. Notice to TUCCI must be sent by certified mail or nationally recognized overnight courier to TUCCI Limited at its then-current principal business address, Attention: Legal Department. TUCCI will send any notice to the most recent postal or email address reasonably available for you. The parties will attempt in good faith to resolve the Dispute for sixty (60) days after receipt of a complete notice. Any applicable limitations period and filing-fee deadline will be tolled during that sixty-day period. Compliance with this paragraph is a condition precedent to commencing arbitration, but either party may seek relief in small claims court without first completing this process if the claim remains within that court&#x2019;s jurisdiction.Arbitration Rules and Administrator. The arbitration will be administered by the American Arbitration Association (&#x201C;AAA&#x201D;) under the AAA Consumer Arbitration Rules and Mediation Procedures in effect when the arbitration is filed, as modified by this provision. If there is a conflict between those rules and this provision, this provision will control to the extent permitted by law. If the AAA is unavailable or declines to administer the arbitration, the parties will attempt in good faith to select another nationally recognized consumer-arbitration administrator. If they cannot agree, a court of competent jurisdiction may appoint an administrator or arbitrator under the Federal Arbitration Act. The arbitrator will be a neutral attorney or retired judge with substantial experience in consumer-product or warranty disputes.Fees, Location, and Hearing Format. TUCCI will pay all arbitration fees and costs that the AAA Consumer Arbitration Rules require the business to pay. The consumer will pay only the filing fee, if any, permitted under those Rules, subject to any applicable fee waiver. Each party will bear its own attorneys&#x2019; fees and costs unless applicable law authorizes the arbitrator to award them. The arbitration may be conducted by telephone, videoconference, or written submissions, or, if an in-person hearing is required, at a location reasonably convenient for you and consistent with the AAA Consumer Arbitration Rules. The arbitrator may award any individual relief available in court, including declaratory, injunctive, statutory, compensatory, and punitive relief, and attorneys&#x2019; fees and costs when authorized by applicable law, but only to the extent necessary to resolve the individual claimant&#x2019;s Dispute. The arbitrator will issue a reasoned written award. &#xA0; Who Decides Arbitrability. A court of competent jurisdiction, and not the arbitrator, will decide any dispute concerning the formation or existence of this arbitration agreement and any challenge to the enforceability of the Individual Proceedings Requirement below. Except for those matters, the arbitrator will decide all issues concerning the interpretation, applicability, scope, or enforceability of this arbitration agreement, including any contention that all or part of it is void or voidable.Individual Proceedings Requirement; Class Action Waiver. YOU AND TUCCI AGREE THAT EACH MAY BRING A DISPUTE AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, MASS, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL PROCEEDING. UNLESS YOU AND TUCCI AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF MORE THAN ONE PERSON OR ENTITY, PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING, OR AWARD RELIEF FOR OR AGAINST ANYONE OTHER THAN THE INDIVIDUAL PARTIES TO THE ARBITRATION.Severability. Except for the Individual Proceedings Requirement, if any part of this arbitration provision is found unenforceable, that part will be severed and the remainder will remain in effect to the fullest extent permitted by law. If a final decision determines that applicable law prevents enforcement of the Individual Proceedings Requirement as to a particular claim or request for relief, that claim or request for relief will be severed and may proceed in court after all arbitrable claims are completed; all other claims will remain subject to individual arbitration. If the Individual Proceedings Requirement is finally held unenforceable in a manner that permits class, collective, consolidated, coordinated, mass, or representative arbitration, then this arbitration provision will be unenforceable as to that proceeding, and the proceeding must be brought in a court of competent jurisdiction. &#xA0; Jury-Trial Waiver.
